Conditions of Use

Introduction & How to Order Prices stated in our Price Guide and on this site are in GBP (Pounds) and are correct as at the date of the last update and do not include VAT. Every endeavor will be made to hold these prices. However, ESM Morris Minors Ltd. reserves the right to alter prices without prior notice.

Value Added Tax

Value Added Tax (VAT) at the current rate will be levied on all orders (excluding books) being dispatched to all countries within the United Kingdom. VAT is not charged on goods dispatched to countries outside of the UK. However, such orders are often subject to local import duty, taxes and Customs clearance, which MUST be paid by you at the port of entry. Such charges are not included in the cost of the goods or delivery prices.

Ordering online or by phone.

When ordering it is important to include complete name and address information. Please also provide the make, model, year, and VIN of the vehicle for which you are ordering. Include mention of any modifications that may affect your order (i.e. 1300 engine). Wherever possible, give us the part number, description and quantity required for each item ordered. Include a phone number and/or email address at which you may be contacted during the day. U.K. Ordering,

We accept orders via our website and via telephone. Remember, supplying details of your car, (i.e. engine, Vehicle Identification Number (VIN) LHD or RHD, year of manufacture and any modifications) saves time and helps us to help you.

Parts in Stock and Back Orders

We keep a large percentage of all parts listed in stock. However, ocasionally a situation may arise where either we do not have stock, or our stock control system may be incorrect. If this is the case we will contact you as soon as possible. We endevour to keep our stock control systems up to date at all times but sometimes due to unavoidable external factors it may be incorrect. We do not back order any parts. You will receive all available parts from your order and we will inform you should any items on the order not be available. 

Overseas Ordering

As with the U.K. we accept orders via our website and by telephone. When ordering, please ensure that you enclose full details of your name, address, telephone number and if possible an eamil address, plus details of your car (i.e. engine, Vehicle Identification Number (VIN) LHD or RHD, year of manufacture and any modifications).

Please note, overseas orders are often subject to local import duties, taxes and Customs clearance, which will need to be paid for at the point of entry. These charges are NOT included in the price of the goods or delivery prices. All relevant Customs forms and documentation needed to ensure the order arrives with the minimum of delay will be included with your shipment. The rules and regulations surrounding import taxes/duties vary depending on the destination country. It is the responsibility of the importer (i.e. the customer) to avail themselves of their local import rules and regulations before ordering. ESM Morris Minors Ltd. is not responsible for the payment of any import duties/taxes. 

If you have any special requirements, please contact us to discuss them. Please remember that delivery charges are dependent upon the size and weight of the shipment. If a quotation is required prior to placing an order, please contact us and we will be pleased to supply a full quotation to you.

Quotations & Payment Methods

We will be pleased to provide a full parts quotation detailing price, availability and relevant shipping costs. Online payments are accepted only by credit/debit card or PayPal. Payment for other orders may be made by cash, personal cheque (to the card guarantee limit), Certified Bank Draft, credit or debit card including: MasterCard, Visa, Maestro, Switch, Delta. Please note that we are unable to accept AMEX or Visa Electron cards for mail-order. If you intend to make payment by Cheque or Bankers Draft when using our fast-mail-order parts service, please confirm parts availability and carriage charges. Return of Goods, Goods correctly supplied in accordance with the customer’s order may only be returned with our permission. We reserve the right to charge a 10% handling charge on such goods. (Excluding VAT)

Title of Goods

Until payment has been made in full by the customer we retain the title to all goods supplied by us. Exchange Units, All exchange units are subject to a surcharge. This surcharge serves two purposes; firstly, it acts as an incentive for you to return your old unit so we may continue to provide reconditioned parts, and secondly it provides us with financial cover if your returned unit proves unsuitable for exchange purposes. Whether or not your returned unit is suitable for exchange purposes cannot be ascertained until it is made available to us for inspection. As a general rule, suitable for exchange basically excludes any items that are beyond reasonable repair or units irrevocably damaged. We are also unable to accept units unless they are returned in whole, complete form (i.e. differential units which are returned partly stripped with no bearings and all the shims missing are not generally accepted), nor do we accept a "box of bits". Surcharges will only be refunded once passed as serviceable. We can arrange for the collection of old units for a fee if required.

Warranty

All parts ordered from Clayton's Austin A30/A35 Spares are fully warranted against defects in materials and workmanship for a period of twelve months from the date of purchase. Warranty settlements will not exceed the cost of the original component.

The warranty does not cover:

1. Labour charges.
2. Failure of or caused by related component(s).
3. Failure resulting from incorrect installation or misuse.

When ordering from this website customers will be required to accept our terms and conditions.We would like to draw your attension to our terms of sending parcels either in the post or via a parcel carrier.We clearly state that you have a choice of how your parcel is sent to you..With every delivery there will be an option to send a parcel via 1st class post at your own risk with no insurance included and not tracked. There will also be a more expensive option to select a delivery method that includes full parcel insurance and tracking. This is the customers choice, no insurance and no tracking means that if your parcel goes missing or gets damaged in the post we will not be in any way liable to replace or refund for a lost parcel. We would alway recommend the tracked, signed and insured services offered. We offer a less expensive 1st class post option without tracking or insurance to give the opportunity to get your parts in the most ecconomical way possible but that is the customers choice. It is important to understand that it will not make any difference to how you pay for your parcel,you have accepted our terms of ordering.
